ÉirePassports is an independent document assistance service operated by LKMST Pty Ltd. In these Terms, “we”, “our”, and “us” refer to ÉirePassports.

By accessing our website, submitting an application, or making payment, you agree to these Terms and our Privacy Policy.

PART A — TERMS & CONDITIONS

1. Nature of Services

ÉirePassports provides private administrative support for Irish passport applications, including document checking, application guidance, and submission assistance.

We are not affiliated with, endorsed by, or connected to the Irish Government, the Department of Foreign Affairs (DFA), or any passport authority.

Clients may apply directly through official government channels at any time.

2. No Legal or Immigration Advice

We do not provide legal, immigration, or government advice. Our services are administrative only.

Final decisions regarding passport issuance are made solely by the Irish Passport Service.

3. Client Responsibilities

You agree that:

  • all information provided is true, accurate, and complete
  • all documents submitted are valid and legible
  • you will respond promptly to requests
  • you are responsible for ensuring eligibility and correctness of information

We are not responsible for delays, refusals, or issues caused by incorrect or incomplete information supplied by you.

4. Communication

All communication is conducted primarily via email and secure digital systems.

By providing your contact details, you consent to receive service-related communications.

5. Fees, Cancellation & Refunds

All fees are clearly displayed prior to purchase. By submitting payment, you agree to these fees and this refund policy.

5.1 Cooling-Off Period (4 Hours)

A 4-hour cooling-off period applies from the time of payment.

If you request cancellation within this period, a refund will be issued minus non-refundable Stripe payment processing fees, which are:

  • Domestic cards: 1.7% + A$0.30 per transaction
  • International cards: 3.5% + A$0.30 per transaction

5.2 After Cooling-Off Period (Before Submission to DFA)

After the 4-hour cooling-off period has ended, but before submission to the Irish Passport Service, a cancellation may be requested.

If approved, any refund will be issued less:

  • a 25% administrative service fee, and
  • non-refundable Stripe processing fees

This reflects administrative handling, system allocation, and commencement of service delivery.

5.3 After Submission to DFA or Third Parties

Once an application has been submitted to the Irish Passport Service (DFA) or any third-party authority, courier, or service provider on your behalf, no refund will be provided under any circumstances, including where the application is pending, delayed, or in progress.

5.4 Exceptional Circumstances (Illness, Death, or Incapacity)

In the event of serious illness, incapacity, or death of the applicant, we may review refund requests on a case-by-case basis.

Where the application has not yet been submitted, any refund may be adjusted to reflect Stripe fees and administrative costs incurred.

Where the application has already been submitted, no refund is available, however reasonable assistance may be provided to an authorised representative where appropriate.

Supporting documentation may be required.

5.5 Consumer Law

Nothing in this policy limits your rights under Australian Consumer Law.

6. Application Timeframes & Inactivity

Clients must submit requested documents within 75 days.

If no communication is received for 6 months, the file may be marked inactive and archived.

Inactive files may be securely deleted after the retention period outlined in our Privacy Policy.

7. Third-Party Services

We use third-party providers such as payment processors, email systems, cloud storage, and couriers.

We are not responsible for delays or failures caused by third parties.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • indirect or consequential loss
  • loss of income, travel, or opportunity
  • delays or decisions made by the DFA or third parties
  • errors arising from incorrect client information

9. Indemnity

You agree to indemnify and hold harmless ÉirePassports and LKMST Pty Ltd against any claims, losses, or damages arising from:

  • incorrect or misleading information provided by you
  • breach of these Terms
  • misuse of our services

10. Important Travel Notice

Do not make travel arrangements until your passport is received.

We are not responsible for costs incurred due to processing delays.

11. Intellectual Property

All website content, branding, systems, and materials remain the property of LKMST Pty Ltd and may not be reproduced without permission.

12. Applications for Minors

For applicants under 18, a parent or legal guardian confirms they have authority to act and accepts full responsibility for all information provided.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the exclusive jurisdiction of Victorian courts.

14. Updates

We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.


PART B — PRIVACY POLICY

15. Information We Collect

  • passport and identity documents
  • supporting application documents
  • communication records
  • payment information

16. How We Collect Information

We collect data when you:

  • complete forms
  • upload documents
  • contact us
  • make payments
  • communicate via email or our systems

17. How We Use Information

We use personal information to:

  • process passport applications
  • communicate with clients
  • manage internal records
  • comply with legal obligations
  • improve services

18. Legal Basis (GDPR Where Applicable)

Where GDPR applies, we rely on:

  • contractual necessity
  • legal obligations
  • legitimate interests
  • consent (where required)

19. Data Storage & Security

We store data securely using encrypted systems with restricted access controls.

We implement:

  • multi-factor authentication
  • access restrictions
  • secure cloud storage
  • audit logs where applicable

We do not store paper copies.

20. Data Retention

We retain personal data for up to 7 years after completion of services, unless otherwise required by law.

After this period, data is securely deleted or anonymised.

Files may be archived after 6–12 months of inactivity before deletion.

21. Sharing of Information

We do not sell personal data.

We may share information only with:

  • Irish Passport Service (DFA)
  • trusted service providers (e.g. Stripe, Google, email platforms, couriers)
  • professional advisors where required by law

22. International Transfers

Your data may be stored or processed in Australia or other jurisdictions where service providers operate, including Ireland.

23. Cookies & Tracking

We use cookies and tracking technologies (e.g. Google Analytics, Meta Pixel) to:

  • analyse website performance
  • improve user experience
  • support marketing and advertising

Where required, non-essential cookies will only be used after consent via a cookie banner.

24. Your Rights

Depending on your location, you may have rights to:
